Hi,

We are registered dealer in gst in delhi and we mostly avail transport services for movement of goods with-in the state as well as outside state for material supply from (registered/unregistered) GTA.

As per gst laws we have already know that as we are the recipient of such services therefore we are liable to pay the gst @ 5% as per RCM.

My questions do we are applicable to avail Input Tax Credit, if not can we be able to claim the amount as Refund.

Please Clarify.......

But Sir,

I have found a list of expenses which is liable to gst & in this list payment of transport service received from GTA is liable to 5% on RCM basis & clearly mentioning that we can able to get ITC.

You will not be able to claim refund of this amount.

However things are confusing here.

It is advised to charge tax at 12% and you will get input tax credit benefit.

You can avail input tax credit if you are charging at 12%.
